Terms of Service

These Terms govern access to the website and services provided by The Humble Artist Foundation, a non-profit organization based in Saint Petersburg, Florida. Please read them carefully before participating in any sweepstakes, contest, promotion, or donation activity.

1. Acceptance of terms

By using the website or Services you agree to these Terms and all applicable laws. If you use the Services on behalf of another party, you represent that you are authorized to do so and that party accepts responsibility for any violation.

2. Description of service

The Foundation operates a charitable sweepstakes website that raises funds to support artists and the arts community. Users may enter sweepstakes, make donations, and access related content. We may modify or discontinue features without notice, subject to applicable law.

3. Eligibility

You must be a legal resident of the 49 United States or the District of Columbia (void in New York, Puerto Rico, and all U.S. territories) and at least 18 years old, or older where required by your jurisdiction. You represent that all information you provide is truthful, accurate, and complete. Where these Terms conflict with a promotion’s Official Rules, the Official Rules control.

4. Intellectual property

All website content — text, images, graphics, logos, video, audio, design elements, software, and overall look and feel — is owned by the Foundation or its licensors. You may view the site and print limited copies for personal, non-commercial use with copyright notices intact. No trademark license is granted without written consent.

Artists submitting demo tracks, guest mixes, or performing at Foundation events retain full ownership of their intellectual property and grant the Foundation a non-exclusive, royalty-free license to stream, play, and promote the material for event operations and promotional media.

5. User conduct

You agree not to use the site for unlawful, fraudulent, or malicious purposes; attempt unauthorized access; submit false information; disrupt the site or introduce malicious code; use automated access without written permission; or otherwise restrict others’ enjoyment or harm the Foundation.

6. Sweepstakes

NO PURCHASE OR DONATION IS NECESSARY TO ENTER OR WIN ANY SWEEPSTAKES. A PURCHASE OR DONATION WILL NOT INCREASE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED BY LAW. Each promotion is governed by its Official Rules, incorporated by reference.

7. Donations

Donations are voluntary and non-refundable except where required by law. The Foundation is a Florida non-profit corporation; contributions are tax-deductible to the extent permitted by law — consult a tax advisor. You represent that you are authorized to use any payment method provided. Third-party payment processors’ terms may apply.

8. Disclaimer of warranties

THE WEBSITE, SERVICES, AND CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES.

9. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, THE FOUNDATION IS NOT LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES. OUR AGGREGATE LIABILITY SHALL NOT EXCEED THE GREATER OF (A) DONATIONS YOU MADE IN THE PRECEDING SIX MONTHS OR (B) ONE HUNDRED U.S. DOLLARS (US $100). Some jurisdictions do not allow these limitations, so they may not apply to you.

10. Indemnification

You agree to indemnify and hold harmless the Foundation from claims arising from your use of the site, participation in sweepstakes, donations, violation of these Terms, or violation of third-party rights.

11. Governing law

These Terms are governed by Florida law. Any action shall be brought exclusively in the state or federal courts serving Pinellas County, Florida.

12. Changes

We may update these Terms at any time by revising the effective date. Continued use after changes constitutes acceptance.
